Disability Labor Pension

The labour pension for disability is assigned in connection with the limitation of the insured person’s working capacity due to mental or physical disorders resulting from illness or injury. The percentage of impairment of bodily functions, the causes, and the duration of disability are determined by the relevant executive authority in accordance with the legislation.

The labour pension for disability is granted to persons whose disability has been determined due to 81–100 percent impairment of bodily functions, provided that their total insurance record is not less than five years and that they have four months of insurance record for each full year of their working-age period. For persons whose disability has been determined due to 31–80 percent impairment of bodily functions, the labour pension for disability is granted if the pension capital recorded in the insurance part of their individual account allows for pension provision not less than the minimum amount of the labour pension and if the required insurance record specified in this article is met.

For military servicemen, including those in active military service, who have been determined as disabled due to 81–100 percent impairment of bodily functions related to war (excluding servicemen deprived of military ranks and other conscripts), the labour pension for disability is granted regardless of the length of service if the disability occurred during the service period or after discharge but as a result of disease or injury (wound, trauma, concussion) sustained during the service period.

The amount of the insurance part of the labour pension for disability is determined by the following formula:

IP = PIC / (T × K)

where:

  • IP – insurance part of the labour pension for disability;
  • PIC – pension insurance capital recorded in the insurance part of the insured person’s individual account as of the date of assigning the labour pension for disability (including the pension capital recorded in accordance with Article 27 of this Law);
  • T – number of months of the expected pension payment period;
  • K – insurance continuity coefficient. The insurance continuity coefficient is determined as the ratio of the number of months of required insurance record for the labour pension for disability to 200.

If a person does not qualify for the labour pension for disability, they are entitled to receive a social benefit in cases provided for by law.

Application procedure:
A citizen may apply to the regional branch of the Fund or to DOST centres in person or through a representative by power of attorney, either in written or electronic form.

Required documents:

  1. A copy of the identity card of the person applying for the labour pension (for foreigners and stateless persons — a copy of the residence permit granting the right to permanent residence in the territory of the Republic of Azerbaijan);
  2. An extract from the medical-social expert examination determining the person’s disability;
  3. Documents confirming social insurance record.

Amount and duration of the pension:
The amount of the pension is determined based on the pension capital accumulated in the individual account according to insurance indicators.

Note: The minimum amount of the pension is 320 manats.
The duration of the labour pension for disability is determined by the relevant executive authority for the period established.
