The following family members of a deceased or perished family head have the right to a labour pension due to the loss of the family head:
1.1. the children of the deceased or perished persons:
1.1.1. under 18 years of age;
1.1.2. persons over 18 years of age whose disability was determined before reaching the age of 18;
1.1.3. those studying full-time at educational institutions, but only up to the age of 23;
1.2. father, mother, husband, or wife who has reached the pensionable age determined under Article 7 of the Law “On Labour Pensions”, or whose disability has been determined due to 61–80 percent or 81–100 percent impairment of bodily functions;
1.3. regardless of age and working capacity, one of the parents, or the husband (wife), or grandfather, grandmother, brother, sister who takes care of the deceased or perished family head’s children, brothers, sisters, or grandchildren under the age of 8 and is not employed.
Application procedure:
A citizen may apply to the regional branch of the Fund or to DOST Centres in person or through a representative under a power of attorney, in writing or electronically.
Documents required for granting a labour pension due to the loss of the family head:
From the military unit, the State Service for Mobilization and Conscription, or other relevant state authorities, a document confirming the fact, cause, and date of death of the military serviceman, as well as a document confirming that the serviceman is missing (when the right to a labour pension arises under Article 17.2 of the Law).
Pension amount and duration:
Based on insurance indicators, the pension amount is determined according to the pension capital accumulated in the individual account.
Note: the minimum pension amount is 320 manats.
The labour pension due to the loss of the family head is granted for the duration of the conditions specified. For persons who have reached the pensionable age established by law, it is granted for life.
If a person does not acquire the right to a labour pension due to the loss of the family head, they have the right to receive a social allowance in cases provided by the legislation.
